The decision of the DPCP came down this Friday
Child abused in daycare: no charges laid in the file
It's official: no charges will be laid in the case of the toddler who was allegedly physically abused at his family daycare in the Vaudreuil-Soulanges area. The decision of the Director of Criminal and Penal Prosecutions (DPCP) was announced on Friday, May 10.
On Thursday, August 3, 2023, the mother noticed a large bruise on her 10-month-old child's right buttock.
On April 18, the child's mother denounced the delays in the case on Paul Arcand's radio show.
Less than a month later, on Friday May 10, the parents learned from a representative of the DPCP that no charges would be laid against the educator concerned.
A communication between the DPCP, the Sûreté du Québec and the parents, which was made available to Néomédia, states that, although the medical report proves that the marks of violence were caused by the use of excessive force, the DPCP is not in a position to lay charges. Why not? Because it can't know who did it, since the woman wasn't alone in the house and doesn't remember anything. Secondly, it states that the file contains only circumstantial evidence, as the victim cannot testify due to her young age, and finally, it states that the doctors are unable to put a date on the injury.
“We understand the facts of the case very well, but we are bitterly disappointed and saddened that Quebec society does not want to protect our children. The facts are there: she abused our son because she didn't respect her contract, which stipulated that she was either with one of her daughters when the other was absent. We can't prove who did this to our son. We are parents, but we feel terrible about what happened. Our son still has psychological scars. We'll never have answers to our questions. We'll never know what really happened in that daycare center,” says the toddler's mother.
According to the parents, the daycare would still be under scrutiny as at least one other case of child abuse would have been under investigation.
“I went on mydaycare.com and it posted spaces for June 2024.So I'm not in a position to say whether it's closed or not,” says the mother.
The family would like to raise the issue with MP Marilyne Picard, as well as Suzanne Roy, the Minister of Family Affairs. “It's unbelievable that family daycare services are so poorly monitored.Anyone can open a facility. It doesn't bother them that there are so many cases of death or violence in family settings. If I were them, I'd be wondering what parents in Quebec are going through,” she concludes.
